I,
hereby agree that HOLISTIC BODY MOVEMENT, LLC (a single-member LLC owned and managed by Amy Fowler, referred to hereafter as the “Company”), has made available to me with its permission on an on-site gym with fitness activities and occasional instruction for my voluntary use for personal exercise, fitness, or other recreational use (“Fitness Activity”). I execute this Fitness Activity Waiver & Release (“Agreement”) in consideration for this permission and in recognition of the fact that the Company would not otherwise make this Fitness Activity available to me unless I agree to the terms of this Agreement. I agree to comply with all applicable laws and to conduct myself with a reasonable standard of care while engaging in the Fitness Activity. I agree to comply with all Fitness Activity instructions prior to and during my participation in the Fitness Activity. I understand and agree that exercise, fitness, and recreational activities including the Fitness Activity are inherently subject to certain dangers and risks. By signing this waiver and release, I agree and acknowledge that I know I should consult a physician prior to undertaking any physically strenuous activity or exercise regimen, including the Fitness Activity, and I represent and warrant to the Company and to Amy Fowler that I have done so.
I hereby assume all risks, dangers, and liability associated with my participation in the Fitness Activity. I agree that the Company, including owner, Amy Fowler, and any affiliated companies, owners, shareholders, directors, officers, agents, and employees, contractors, attorneys, insurers and reinsurers (collectively “Company Releasees”), have no obligation to eliminate or reduce any such dangers or risks or to provide a safe place in connection with my exercise, fitness, or recreational participation in the Fitness Activity. I further permanently and irrevocably release, and will indemnify and hold harmless Company Releasees from and against any claims for injuries to me (including injuries causing death) that I may sustain while participating in the Fitness Activity, including any such claims that may arise (in whole or in part) from the alleged or actual negligence or other fault of a Company Releasee, regardless of whether such alleged or actual negligence or other fault be active, passive, sole, concurrent, or due to an alleged or actual breach of any statutory duty. I further agree that my participation in the Fitness Activity is entirely voluntary, not part of my job duties or work expectations, is not compensated time, and that the Company has no expectation, express or implied, that I participate in the Fitness Activity. I agree that my promises in this Agreement are made on behalf of myself and my heirs, executors, administrators, and assigns.
